HOW Companies Claim Information

As part of the liquidation process for the HOW Companies, the Deputy Receiver set a deadline of Jan. 12, 2009 by which all claims against the HOW Companies needed to be filed.

Any “Eligible Builder” seeking return of capital contributions made to the HOW Companies was required to file a claim by that deadline, and many NAHB members did so. However, “Builder Distributees” do not need to submit claims for their share of the residual assets of the companies.

As a service to the NAHB membership, NAHB staff is looking at ways to ensure that the receiver has up-to-date information for all eligible NAHB member builders.

Contact Information for Eligible Builders and Builder Distributees

Download the contact list for your state or states to ensure that your contact information is current.

If the information listed on the spreadsheet(s) is inaccurate or incomplete, the receivership staff requests that Eligible Builders and Builder Distributees submit:

(1) updated contact information (i.e., the builder’s current name and mailing address, and the name, phone number, mailing address, and e-mail address of the builder’s authorized representative);

(2) TWO forms of confirmation of the builder’s current name and address (e.g., utility bill, insurance bill), if either the name or address has changed from that which is listed; and

(3) if the builder’s name has changed since October 14, 1994 (e.g., as the result of a merger, acquisition, or name change), or if the builder no longer exists (e.g., as the result of dissolution), proof that the responding entity is the legal successor to the rights of the Eligible Builder or Builder Distributee as its name appeared in the HOW Companies’ records as of the later of October 14, 1994, or the date on which an Eligible Builder submitted a Proof of Claim for capital contributions that was subsequently approved.

Information Regarding Counsel, Representatives, or Assignees

If an Eligible Builder or Builder Distributee has engaged an outside counsel or representative, or has assigned all or any portion of its rights as an Eligible Builder or Builder Distributee, the receivership staff requests that the Eligible Builder or Builder Distributee submit the name and complete contact information for the counsel, representative, or assignee.
